These Terms constitute a legally binding agreement between you and INIC Communications Private Limited under the Information Technology Act, 2000 and applicable Indian laws. Please read them carefully before using the Service.
1. Acceptance of Terms
By accessing or using INIC CheckIn (the "Service"), you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you must not use the Service.
These terms constitute a legally binding agreement between you and INIC Communications Private Limited ("INIC", "we", "us", "our") under the Information Technology Act, 2000 and other applicable Indian laws. Your continued use of the Service after any changes to these Terms constitutes acceptance of those changes.
2. Service Description
INIC CheckIn is a cloud-based face recognition attendance management system. The Service includes:
- Face recognition check-in via Android tablet kiosks
- Real-time attendance dashboard (web-based)
- Attendance reports and analytics
- Employee and organisation management
- Email-based account and device registration
INIC reserves the right to modify, suspend, or discontinue any feature or aspect of the Service at any time, with or without notice.
3. Account Registration & Eligibility
- You must be at least 18 years old and authorised to represent your organisation
- One account per organisation during trial; one admin per account
- You are responsible for maintaining the confidentiality of your login credentials
- Provide accurate, current, and complete information; false information may result in immediate account termination
- Email verification is required to activate your account
- INIC reserves the right to refuse or revoke registration at its sole discretion
You are responsible for all activities that occur under your account. Notify INIC immediately at info@inic.in if you suspect any unauthorised access.
4. Free Trial
- All new accounts receive a 14-day free trial with full access to all features
- Trial is limited to 5 employees and 1 kiosk device
- No payment information is required to start the trial
- At the end of 14 days, the account is automatically deactivated unless upgraded to a paid plan
- Your data is retained for 30 days after trial expiry; you may export it or upgrade within this window
- INIC reserves the right to modify or discontinue the trial offering at any time
5. Subscription Plans & Payment
After the free trial, continued access to INIC CheckIn requires a paid subscription. Current plans:
- Pro Plan — ₹999/month (up to 50 employees, 3 kiosk devices)
- Enterprise Plan — Custom pricing (contact info@inic.in)
- All prices are in Indian Rupees (INR) and exclusive of applicable GST
- Subscriptions are billed monthly; payment is due at the start of each billing cycle
- INIC reserves the right to change pricing with 30 days' prior notice via email
- Non-payment will result in service suspension after a 7-day grace period
6. Cancellation & Refund Policy
- You may cancel your subscription at any time by emailing info@inic.in
- Cancellation is effective at the end of the current billing period
- No refunds are issued for partial months
- Trial accounts do not require cancellation — they expire automatically after 14 days
- Upon cancellation, your data is retained for 30 days and then permanently deleted
- If you believe you were charged in error, contact us within 7 days of the charge date
7. Face Recognition Data
Important — Biometric Data
This section governs the collection and use of facial biometric data. Organisations using INIC CheckIn bear responsibility for obtaining employee consent.
- INIC CheckIn uses face recognition technology to identify employees at kiosk check-in points
- Facial biometric data — stored as 128-point mathematical facial descriptors — is collected, processed, and stored
- Employee faces are enrolled by the organisation administrator with the employee's awareness
- All facial data is stored exclusively on servers located in India, operated by INIC Communications
- Facial data is used exclusively for attendance marking within your organisation
- Facial data is never shared with third parties, sold, or used for any purpose other than attendance
- Upon account deletion or subscription cancellation, all facial data is permanently deleted within 30 days
- Organisations are solely responsible for obtaining explicit employee consent before enrolling their faces
- Employees have the right to request deletion of their facial data through the organisation administrator
8. Acceptable Use Policy
You agree NOT to use the Service for any of the following:
- Any unlawful purpose or in violation of applicable Indian laws
- Enrolling individuals without their knowledge or consent
- Reverse-engineering, decompiling, disassembling, or hacking the Service or its algorithms
- Monitoring or tracking individuals who are not employees of your organisation
- Sharing your account credentials with unauthorised persons
- Interfering with the Service's infrastructure or disrupting other users' access
- Circumventing access restrictions, security measures, or usage limits
- Introducing malware, viruses, or any malicious code into the Service
Violation of this policy may result in immediate account suspension without refund.
9. Intellectual Property
- All software, algorithms, face recognition models, designs, and content within INIC CheckIn are the exclusive property of INIC Communications Private Limited
- You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service during your subscription period
- You may not copy, modify, distribute, sublicense, or create derivative works from any part of the Service
- Your organisation's data — employee records, attendance logs, and reports — remains your property
All trademarks, logos, and service marks displayed in INIC CheckIn are the property of INIC Communications Private Limited.
10. Data Storage & Security
- All data — including attendance records, employee information, and facial descriptors — is stored on servers physically located in India
- INIC implements reasonable security measures including TLS/HTTPS encryption, encrypted storage, access controls, and regular backups
- INIC is not liable for data loss or breaches due to events beyond its reasonable control (force majeure)
- You are responsible for maintaining the security of your admin account credentials
In the event of a confirmed data breach affecting your account, INIC will notify you within 72 hours of discovery.
11. Limitation of Liability
- INIC's total aggregate liability shall not exceed the amount paid by you in the 3 months preceding the claim
- INIC is not liable for indirect, incidental, special, punitive, or consequential damages
- INIC is not liable for loss of profits, loss of data, loss of business, or business interruption
- The Service is provided "as is" — INIC makes no warranty of uninterrupted or error-free operation
- INIC does not guarantee 100% accuracy of face recognition results; human override is always available
Some jurisdictions do not allow exclusion of certain warranties or liability; in such cases, INIC's liability is limited to the maximum extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless INIC Communications Private Limited, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service in violation of these Terms
- Violation of any third-party rights, including employee privacy rights regarding biometric data
- Failure to obtain required consents before enrolling employee facial data
- Any data you submit, store, or process through the Service
13. Modifications to Terms
INIC may update these Terms at any time. We will notify you via email at least 14 days before changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
If you do not accept the revised Terms, you must stop using the Service and email us at info@inic.in to close your account.
14. Termination
INIC may suspend or terminate your account immediately and without prior notice if you violate these Terms, engage in fraudulent activity, or if required by law. In such cases, no refund will be issued.
You may terminate your account at any time by emailing info@inic.in. Upon termination, your access is revoked and data is retained for 30 days before permanent deletion.
15. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India. The courts of Bhopal, Madhya Pradesh, India shall have exclusive jurisdiction over any disputes arising from or relating to these Terms or the Service.
The parties agree to first attempt resolution of any dispute through good-faith negotiation for a period of 30 days before initiating formal legal proceedings.
